These Terms of Service ("Terms") govern your use of NonMouse, the NonMouse website, downloadable builds, and any related early-access or supporter services (collectively, the "Service").

By using NonMouse or purchasing an early-access/supporter license, you agree to these Terms.

1. What NonMouse Is

NonMouse is a webcam-based gesture mouse application that lets you control a computer with hand movements. The core project is provided as open-source software through GitHub and related distribution channels.

Paid early-access or supporter offerings may include convenience builds, setup guidance, early updates, or support for continued development. Purchasing a supporter license does not remove access to the open-source project.

2. Open-Source Software

The open-source NonMouse code is governed by the license published in the NonMouse GitHub repository. If there is any conflict between these Terms and the open-source license for the code itself, the open-source license controls for use of that code.

Downloadable packaged builds and optional supporter services may be distributed separately from the source code for convenience.

3. User Responsibilities

You are responsible for:

• Using NonMouse safely and appropriately in your environment
• Ensuring that your webcam, operating system, and permissions are configured correctly
• Complying with applicable laws and workplace or device-use rules
• Maintaining backups and avoiding use in situations where malfunction could cause harm

4. Payments and Supporter License

Payments for early-access or supporter licenses are processed by Buy Me a Coffee or another listed payment provider. Payment details are handled by the payment provider and are not stored by NonMouse directly.

A supporter purchase is primarily a way to support development and receive any described convenience benefits. It is not a guarantee of a specific future feature, release date, or outcome.

Unless otherwise stated at checkout, supporter purchases are one-time payments.

5. Refunds

If you purchased by mistake or cannot use the paid offering, contact us within 14 days of purchase. Refunds may be provided at our discretion, subject to payment processor rules and fraud-prevention checks.

6. No Warranty

NonMouse is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We do not guarantee that NonMouse will be error-free, uninterrupted, compatible with every device, or suitable for any particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of data, profits, or business arising from your use of NonMouse or the Service.

8. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date.
